General Terms and Conditions of Sale
These terms and conditions of sale are concluded on the one hand by the company SASU VAGANTES, with a share capital of €500, whose registered office is located at 7 quai de la prevalaye - 35000 RENNES, registered in the Trade and Companies Register under number 87759630400015 and managing the Goémon website (go-em-on.fr) and, on the other hand, by any natural or legal person wishing to make a purchase via the Goémon website, go-em-on.fr, hereinafter referred to as "the buyer".
Article 1. Purpose
These terms and conditions of sale aim to define the contractual relations between VAGANTES and the buyer and the conditions applicable to any purchase made through the Goémon website, go-em-on.fr. The acquisition of a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges having read before ordering. Before any transaction, the buyer declares on the one hand that the purchase of products on the Goémon website, go-em-on.fr is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have the full legal capacity, allowing him to commit himself under these general conditions of sale.
The company VAGANTES retains the possibility of modifying these conditions of sale at any time, in order to comply with any new regulations or for the purpose of improving the use of its site. Therefore, the applicable conditions will be those in force on the date of the order by the buyer.
Article 2. Products
The products offered are those listed on the Goémon website, go-em-on.fr of the company VAGANTES, within the limits of available stocks. The company VAGANTES reserves the right to modify the assortment of products at any time. Each product is presented on the website in the form of a description listing its main technical characteristics. The photographs are as faithful as possible but do not engage the Seller in any way. The sale of products presented on the Goémon website, go-em-on.fr is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.
Article 3. Prices
The prices appearing on the product sheets of the online catalog are prices in Euros (€) all taxes included (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The company VAGANTES reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased according to the total amount of the order.
Article 4. Order and Payment Terms
Before any order, the buyer must create an account on the Goémon website, go-em-on.fr. On each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information. The company VAGANTES offers the buyer to order and pay for his products in several stages, with 2 payment options to choose from:
Secure payment by Paypal system (with or without an account):
The customer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the customer, as well as the name of the carrier. Then, the customer chooses the payment method of his choice: "Payment by Paypal". The next step offers him to verify all the information, read and accept these general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the "Confirm my order" button. Finally, the customer is redirected to the secure PAYPAL interface to securely enter his Paypal account or personal credit card details if he does not have a Paypal account. If the payment is accepted, the order is registered and the contract is definitively formed. Payment by Paypal account or credit card is irrevocable. In the event of fraudulent use of the latter, the buyer may demand the cancellation of the payment by card, the sums paid will then be re-credited or refunded. The liability of the holder of a bank card is not engaged if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain reimbursement of the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest the debit, in writing, with his bank, within 70 days of the transaction, or even 120 days if the contract binding him to it so provides. The amounts debited are reimbursed by the bank within a maximum of one month after receipt of the written dispute lodged by the cardholder. No fees for returning the sums may be charged to the holder.
Secure payment by Credit Card:
A secure payment procedure by credit card on the Internet has been set up in collaboration with Banque Populaire Grand Ouest. Only bank cards bearing the CB, VISA, EUROCARD, MASTERCARD symbols are accepted. During your payment, you enter your credit card number and its expiry date. This information is immediately encrypted on your computer before being sent over the Internet. Thus, no confidential information circulates on the network without being previously encrypted. Your bank details are in no way stored on the servers of Goémon, go-em-on.fr. Payments by credit card are secured by an online payment system to SSL standards, and all the banking information you provide us with during your online purchase is neither stored nor visible on the Internet. Goémon, go-em-on.fr therefore guarantees the confidentiality of your data.
Article 5. Retention of Title
The company VAGANTES retains full ownership of the products sold until full payment of the price, in principal, fees and taxes included.
Article 6. Withdrawal
Pursuant to Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of transport costs.
Article 7. Delivery
Deliveries are made to the address indicated on the order form which can only be in the agreed geographical area. Orders are made by La Poste via COLISSIMO, a delivery service with tracking, delivery with signature. Delivery times are only given as an indication; if these exceed thirty days from the order, the sales contract may be terminated and the buyer refunded. The company VAGANTES can provide by e-mail to the buyer the tracking number of his package. The buyer is delivered to his home by his postman. In the event of the buyer's absence, he will receive a calling card from his postman, which allows him to collect the ordered products from the nearest post office, for a period indicated by the postal services. The risks associated with transport are the responsibility of the purchaser from the moment the articles leave the premises of the company VAGANTES. The buyer is required to check in the presence of the La Poste employee or the delivery person, the condition of the packaging of the goods and their contents upon delivery. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
As part of shipments without signature, the tracking number can be communicated to you on request. The tracking information provided by the carrier is proof of good receipt.
Article 8. Warranty
All products supplied by the company VAGANTES benefit from the legal guarantee provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned to the company VAGANTES which will take it back, exchange it or refund it. All claims, requests for exchange or refund must be made by mail to the following address: contact@go-em-on.fr, within thirty days of delivery.
Article 9. Responsibility
The company VAGANTES, in the distance selling process, is only bound by an obligation of means. Its liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, service disruption, or other unintentional problems.
Article 10. Intellectual Property
All elements of the Goémon website, go-em-on.fr are and remain the intellectual and exclusive property of the company VAGANTES. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of photos, logos, visuals or text.
Article 11. Personal Data
In accordance with law 78-17 of January 6, 1978, as amended by law n° 2018-493 of June 20, 2018, promulgated on June 21, 2018, the buyer has a right of access and rectification of data concerning him. Through Goémon, and only if the customer has given his initial consent at the time of registration. He may thus receive proposals from other companies. Article 12. Settlement of Disputes
These distance selling conditions are subject to French law. For all disputes or litigation, the competent court 1 will be that of Rennes
